PROPERTY CLEARANCE SERVICE AGREEMENT

1. Parties
This Agreement is between:
The Service Provider:
Swinley house clearance , referred to as “we”, “us”, or “the Company”.
The Client:
The individual or organisation requesting the clearance service.
Both parties agree to the following terms and conditions.
2. Scope of Service
We will provide property clearance services, which may include:
House, flat, garage, loft and garden clearance
Removal and transport of waste and unwanted items
Shed / outbuilding dismantling and removal
Garden waste removal
Vaccuming after clearance (if requested)
Recycling and disposal at licensed waste facilities
Resale or donation of reusable items
The specific services and costs will be detailed on the Quote/Job Sheet, which forms part of this Agreement.
3. Quotations
3.1 All quotes are based on information provided by the client.
3.2 On-site price adjustments may occur if:
the volume of waste is greater than described
access to the property is restricted or hazardous
additional labour or equipment is required
unexpected items are found (e.g. heavy items, hazardous materials)
3.3 The client will be informed of any price changes before work continues.
3.4 Quotes are valid for 14 days unless otherwise stated.
4. Payment Terms
4.1 Payment is due immediately upon job completion, unless agreed otherwise in writing.
4.2 We accept:
Cash
Bank transfer
Card payments (if available)
4.3 Commercial clients may be offered 7–14 day invoice terms.
4.4 Ownership of all removed waste passes to the Company only after payment is received.
5. Cancellations
5.1 Booked jobs cancelled with less than 24 hours’ notice may incur a cancellation charge of:
£50 for small jobs
£100 for medium/large jobs
5.2 If we arrive on site and cannot gain access, a call-out fee of £50–£100 may apply depending on distance and time lost.
6. Waste Disposal & Legal Compliance
6.1 We are a licensed Upper Tier Waste Carrier and will dispose of all waste legally.
6.2 Waste will be transferred only to licensed waste facilities.
6.3 We will provide Waste Transfer Notes upon request.
6.4 We do not accept responsibility for any items removed where the client has failed to clearly identify items to be kept.
6.5 Hazardous materials (such as asbestos, chemicals, paint, clinical waste) are not included unless previously agreed and priced.
7. Access & Safety
7.1 The client is responsible for ensuring clear and safe access to the property.
7.2 We may refuse work if conditions are unsafe (e.g. structural issues, dangerous animals, biohazards).
7.3 Additional charges may apply for:
extremely cluttered environments
narrow access
multi-story buildings without lift access
items requiring dismantling.
8. Resale, Recycling and Donation of Items
8.1 Items removed during clearance become the property of the Company unless otherwise agreed.
8.2 We may resell, recycle, upcycle, or donate items to charities.
8.3 Any resale value does not reduce the price unless agreed prior in writing.
9. Liability & Insurance
9.1 The Company holds:
Public Liability Insurance
Employer’s Liability Insurance
Commercial Vehicle Insurance
9.2 We are not liable for:
Pre-existing damage
Hidden structural issues
Damage caused by poor access or unsafe environments
Loss of items not clearly separated by the client
9.3 The client is responsible for informing us if any items in the property must not be removed.
10. Damage
10.1 While every care is taken, minor scuffs, scratches, or marks may occur when removing large or heavy items from tight spaces.
10.2 The Company will not be held responsible for such minor damage unless caused by negligence.
10.3 Any claims must be made in writing within 48 hours of job completion.
11. Cleaning Services
If cleaning is requested:
11.1 We provide basic clearing, sweeping, and removal of debris unless otherwise agreed.
11.2 Deep cleaning or specialist cleaning (mould removal, biohazard cleaning) requires a separate agreement.
12. Shed/Structure Removal
12.1 We will dismantle and remove sheds/outbuildings as agreed.
12.2 We do not undertake structural building demolition.
12.3 Client must ensure no electrical, water, or gas connections remain live.
13. Garden Waste & Green Waste
13.1 Charges are based on weight and volume.
13.2 Soil, rubble, and hardcore incur additional disposal fees.
14. Failed or Partial Clearance
If work cannot be completed due to client issues (blocked access, unsafe conditions), we may charge for:
time spent
travel
partial clearance
disposal already completed
15. Termination
We reserve the right to terminate the job immediately if:
we face abusive or unsafe conditions
the job details were misrepresented
illegal items or hazardous materials are discovered
16. Governing Law
This Contract is governed by the laws of England & Wales.
Any disputes will be resolved first via negotiation, and if needed through local courts.
